# Prohibited Items

To ensure the safety of both buyers and sellers, some types of plants and other products are prohibited on Palmstreet. The following list should not be considered exhaustive and is subject to change.

* Plants intended for mind-altering, hallucinogen or otherwise drug-related use, including but not limited to marijuana, salvia, opium, kratom, peyote (all species of lophophora), psilocybin, and mescaline (including San Pedro Cactus)
* Poached plants - Stephania erectra, as well as any other plant that is harvested from its natural environment
* Plants that are toxic or poisonous, including but not limited to hemlock, nightshade, oleander, and snakeroot
* Any products that are restricted at local, state, and federal levels, including but not limited to any endangered and invasive species
* Any endangered species, especially those governed by [CITES](https://cites.org/eng)
* Original artwork by an artist other than the seller, without that artist's consent.
* Food items are currently in pilot test right now - if you're interested in applying to sell food or beverage items, please review the requirements via this [LINK](https://palmstreet.app/blog/snackmakers-beverage-brands-food-creators).
* Political party items of any kind.
* Seashells
* Counterfeit Labubu
* MLM type accounts or items.
* B2B sales, unless previously approved by Palmstreet.

For sales of prohibited items or verified counterfeit items on or after September 1st, 2025, the following penalties will be applied to sellers:

* **Sale Cancellation:** All prohibited sales will be immediately canceled
* **Full Refund to Buyer:** The full purchase amount will be returned to the buyer
* **Seller Penalty:** A penalty equal to 3 times the item's selling price will be deducted from the seller's balance
* **Possible Suspension:** Repeated violations may result in temporary or permanent suspension from our platform

It is the responsibility of both buyers and sellers to stay up-to-date with local, state, and federal regulations. Please consult the guidance provided by the [USDA](https://www.usda.gov/), your state’s Department of Agriculture, and any shipping carriers you use.
