Items That Can't Be Sold on Palmstreet
To ensure the safety of both buyers and sellers, some types of plants and other products are prohibited on Palmstreet. The following list should not be considered exhaustive and is subject to change.
Plants intended for mind-altering, hallucinogen or otherwise drug-related use, including but not limited to marijuana, salvia, opium, kratom, peyote (all species of lophophora), psilocybin, and mescaline (including San Pedro Cactus)
Poached plants - Stephania erectra (unless you can provide the name of the nursery where you acquired it, or import documentation), as well as any other plant that is harvested from its natural environment
Plants that are toxic or poisonous, including but not limited to hemlock, nightshade, oleander, and snakeroot
Any products that are restricted at local, state, and federal levels, including but not limited to any endangered and invasive species
Any endangered species, especially those governed by CITES
Original artwork by an artist other than the seller, without that artist's consent

Political party items of any kind
Seashells
Counterfeit Labubu dolls
MLM type accounts or items
B2B sales, unless previously approved by Palmstreet
For sales of prohibited items or verified counterfeit items on or after September 1st, 2025, the following penalties will be applied to sellers:
Sale Cancellation: All prohibited sales will be immediately canceled
Full Refund to Buyer: The full purchase amount will be returned to the buyer
Seller Penalty: A penalty equal to 3 times the item's selling price will be deducted from the seller's balance
Possible Suspension: Repeated violations may result in temporary or permanent suspension from our platform
It is the responsibility of both buyers and sellers to stay up-to-date with local, state, and federal regulations. Please consult the guidance provided by the USDA, your state’s Department of Agriculture, and any shipping carriers you use.
Important Notice for Sellers Shipping to California
If you are a seller shipping plants or plant material to California, please be aware that all such shipments must comply with California entry requirements. Shipments of plants and related material into California are subject to regulation by the California Department of Food and Agriculture (CDFA). It is each seller’s responsibility to ensure that their items meet these requirements before shipping. Failure to adhere to California’s entry requirements may result in shipment rejection, destruction, or other regulatory enforcement.

Palmstreet is committed to maintaining a trustworthy, safe, and fair marketplace for all buyers and sellers.
The sale, listing, or giveaway of counterfeit or inauthentic products is strictly prohibited. This policy applies to all beauty and fashion items, including apparel, handbags, accessories, shoes, and cosmetics.
What Is Considered Counterfeit?
Counterfeit items are products that are imitations, unauthorized replicas, or fake copies of genuine branded products. This includes—but is not limited to:
Items using a brand name, logo, or any intellectual property without authorization from the rights holder
Replicas or “inspired by” products passed off as originals
Items with intentionally falsified features (such as fake serial numbers, certification marks, or signatures)
Additional restrictions for Gift-With-Purchase (GWP) / VIP and upcycled items:
The following items may not be sold, listed, or given away on Palmstreet:
Counterfeit or inauthentic Gift With Purchase (GWP) / VIP items – “gift with purchase,” PR, or VIP items that are not genuine, or where the seller cannot verify that they came from an authorized brand order, event, or retailer; bulk lots of branded GWP / VIP items that appear inconsistent with normal consumer purchasing behavior, or that Palmstreet, in its discretion, believes are likely to be counterfeit or diverted.
Misrepresented GWP / VIP items – GWP / VIP items presented or priced as if they are full‑size retail products, or bundled and marketed in a way that falsely suggests sponsorship or affiliation by another brand.
Misleading or counterfeit upcycled items – upcycled or reworked items that use branded parts (for example, using luxury bag hardware or canvas in jewelry, keychains, charms, or accessories) and are marketed as if they were made, endorsed, or authorized by the original brand, or that conceal or blur logos, use code names, or otherwise attempt to evade brand or buyer scrutiny.
Upcycled or altered branded items not clearly disclosed as such, or sold in a manner to imply they are original.
Upcycled items that cannot be tied to an authentic source item (for high‑risk luxury brands) – if Palmstreet requests proof that the original donor item for an upcycled piece (e.g., Chanel, Louis Vuitton, Hermès, Gucci, etc.) was authentic and the seller cannot provide reasonable documentation, the item may be removed and the seller may lose selling privileges on the platform.
*Authentic GWP / VIP and clearly disclosed upcycled items may be sold on Palmstreet, as long as branding is truthful, authenticity can be supported if requested, and buyers are not misled about the origin or sponsorship of the product.
Seller Responsibilities
Sellers must only list, sell, or give away authentic items that were lawfully made by, or on behalf of, the brand owner
Sellers are responsible for ensuring their items are genuine and for providing proof of authenticity (such as original receipts, certificates, or other verifiable documentation) if requested by Palmstreet
Do NOT list an item if authenticity cannot be verified or if you are uncertain of its origin
Do not use tactics to conceal or misrepresent branding (such as hiding or blurring logos, or using code names for brands)
Listing counterfeit products, knowingly or unknowingly, may result in enforcement actions, including removal of listings, restriction or suspension of the selling account, and/or legal consequences
Buyer Protections
Buyers who suspect that an item they’ve received is counterfeit should report it to Palmstreet promptly, including photos or other evidence
Palmstreet may require buyers to return the item for authenticity inspection
If an item is determined to be counterfeit or authenticity cannot be confirmed, the buyer will receive a full refund, including shipping. The seller will not receive payment for the item
Enforcement Actions
Counterfeit listings will be removed immediately
Sellers of counterfeit items may have their selling privileges suspended or terminated
Palmstreet may retain or dispose of counterfeit items at its sole discretion
In cases of repeated or egregious counterfeit activity, Palmstreet will work with law enforcement and rights holders and may provide information as required by law
Reporting Intellectual Property Violations
Rights holders (brands, trademark owners, copyright owners) may contact Palmstreet to report suspected counterfeit or infringing items
Palmstreet will review reports promptly and take appropriate actions to protect its community and brands
Commitment to Authenticity
Palmstreet values a marketplace built on trust. We will continuously monitor, investigate, and address counterfeiting upon discovery or when alerted by brands, buyers, or third parties. By using Palmstreet, all users agree to abide by this policy and all applicable laws regarding authenticity and intellectual property.
